Home occupation - Class 1 permit

The basic rule for a Home Occupation - Class 1 is that the home-based business must not be visible from outside the home.  The business must be conducted in the home by a resident and have no impact on the surrounding neighbours.

 

Some examples of home-based businesses that may fit under the Home Occupation - Class 1 rules are "desk and telephone" occupations, cottage crafts or a consultant's office (three or fewer visits per week).

A Home Occupation - Class 1 clearance form specifies the rules you must follow and is valid for as long as you operate the business within those rules.

General Rules for Home Occupations - Class 1

  1. You must live in the home associated with the home occupation.

  2. Only two Home Occupations - Class 1 are allowed at the home.

  3. The business shall use no more than 20% of the floor area of the home or 30 square metres, whichever is less.

  4. No part of any garage or accessory building can be used for the business.

  5. There can be no outside storage of material, goods, or equipment on or near the site.

  6. The business cannot be visible from the outside.

  7. The business cannot create any kind of nuisance by way of electronic interference, dust, noise, odour, smoke, bright light or anything of an objectionable nature which is detectable from outside the home.

  8. There can be no employee or business partners working at the home who do not live at the home.

  9. There can be no more than 3 visits per week by clients, staff, and/or couriers to the home associated with the business.

  10. No more than one commercial vehicle, maximum 4536 kilograms gross vehicle weight, associated with the business, can be parked at or near the home.

  11. No vehicles over 4536 kilograms gross vehicle weight, associated with the business, can be parked or stored at or near the home.

  12. Must not directly sell goods at the premises, unless they are incidental and related to the service provided by the business.

  13. No form of advertising, related to the business, is allowed on the site.

  14. The address of the home occupation cannot be advertised to the public.

 
Please note: If you cannot comply with every one of the above rules, you must apply for a Development Permit for a Home Occupation - Class 2.
